The use of any NHG HealthBot provided by the NHG Health and/or its institutions and affiliates (which includes the live chat service with our customer service representatives, collectively and individually, as the case may be, “the NHG HealthBot”) is governed by the terms and conditions (“Terms") below. By accessing, browsing or using the NHG HealthBot, you acknowledge that you have read and understood these Terms and unconditionally agree to be legally bound by them and any amendments thereto from time to time and to comply with all applicable laws and regulations.

 

The use of the NHG HealthBot (which includes the live chat service with our customer service representatives) is governed by the terms and conditions (“Terms") below. By accessing, browsing or using the NHG HealthBot, you acknowledge that you have read and understood these Terms and unconditionally agree to be legally bound by them and any amendments thereto from time to time and to comply with all applicable laws and regulations.

 

If you are not agreeable to these Terms, please discontinue the use of the NHG HealthBot immediately.

In these Terms, the words “we", “our" and “us" refer to the NHG Health and/or its institutions and affiliates.

 

1. Variation of Terms

 

1.1  We may revise these Terms and any other information contained in the NHG HealthBot at any time without notice. It is your responsibility to check the Terms periodically for changes because they are legally binding on you.

 

2. Right of Access

 

2.1  We may modify, suspend, discontinue or restrict the use of the NHG HealthBot, any portion thereof or any content at any time, with or without notice, and without liability.

 

3. Intellectual Property and Restriction on Use

 

3.1  The materials displayed in or communicated via the NHG HealthBot, including but not limited to information and software programmes, all text, graphics, user interfaces, visual interfaces, photographs, trademarks, trade names, logos, audio, video and computer code (“Contents") are protected by copyright, trademark and other forms of proprietary rights. The intellectual property rights in the Contents are either owned by, licensed to, or controlled by NHG Health. “NHG Health" and other graphics, logos, designs, page headers, button icons, scripts and service names are registered trademarks, trademarks or trade dress of NHG Health or of the NHG Health institutions / NHG Health affiliates (including without limitation NHG Health, Tan Tock Seng Hospital, National Centre for Infectious Diseases, National Healthcare Group Polyclinics, Khoo Teck Puat Hospital, Woodlands Health, Institute of Mental Health, Yishun Community Hospital, National Skin Centre, Admiralty Medical Centre, NHG Diagnostics, NHG Pharmacy andNHG College) and may not be used, including as part of trademarks and/or part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without prior written permission.

 

3.2  Except as permitted by any written law, no part of the NHG HealthBot and no Contents may be reproduced or re-used for any commercial purposes whatsoever without prior written permission from NHG Health. You may not upload or republish the material in the NHG HealthBot on any internet, or incorporate the information in any other database or compilation, and any other use of the Contents other than as specifically authorised herein without the prior written permission of NHG Health is strictly prohibited. You are not permitted to use the NHG HealthBot for any data mining, robots, scraping or similar data gathering or extraction methods.

 

3.3  None of the Contents may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without NHG Health's prior written permission or unless permitted by law.

 

3.4  Any unauthorised usage of the NHG HealthBot and its Contents may be considered an offence under any relevant laws (including, but not limited to, the Computer Misuse Act 1993, the Personal Data Protection Act 2012 or the Cybersecurity Act 2018).

 

4. Privacy Policy

 

4.1  You may provide information when interacting with the NHG HealthBot (including during your live chat with our customer service representatives via the NHG HealthBot) which includes personal data. You consent to us and/or our officers/representatives to collect, use and disclose your personal data in accordance with our Data Protection Policy the terms of which are also incorporated into these Terms by reference and apply to your use of the NHG HealthBot.  

 

4.2  If you provide us with another person's personal data (including your family members), you warrant that:

i.    you are authorised to act on his/her behalf; and

ii.    he/she accepts that his/her personal data will be subject to these Terms (as amended from time to time).

 

4.3  You agree that your personal data may be collected, used and disclosed, from time to time, for the following purposes (“Purposes"):

i.    to verify your identity;

ii.    to assist you with your query or complaint;

iii.    for our customer service representatives to contact you to resolve any issues you may have or for follow up purposes; and

iv.    purposes which are reasonably related to the aforesaid.

 

4.4  You agree that that we may disclose your personal data for the Purposes to our officers, representatives, any institution or affiliate of NHG Health, and any of NHG Health's partners (including any Government agency or third parties involved in NHG Health patient care).

 

4.5  When you provide us with personal data:

i.    We may access, use or disclose your personal data:

a.    without your express or informed consent if such access, use or disclosure is permitted by the Singapore Personal Data Protection Act 2012 (“PDPA"), as may be clarified by written guidance issued by the Personal Data Protection Commission from time to time, or and other any written law,

b.     if it falls within one of the purposes which consent is deemed under the NHG Health PDPA notification to patients found at this link Data Protection Policy; or

ii.    We may from time to time disclose your personal data to our agents who process data on our behalf and act as our data intermediaries. In that event, these agents are only permitted to use and process the personal data for our purposes, and not for other purposes.

 

4.6  To safeguard your personal data, all electronic storage and transmission of personal data is secured with appropriate security technologies.

 

4.7  We retain personal data as may be required for legal or business purposes. We will take reasonable steps to dispose or anonymise personal data that is no longer needed for such purposes.

 

5. Disclaimers and Limitation of Liability

 

5.1  You understand and agree that any use of the NHG HealthBot is at your own risk, that the information on the NHG HealthBot is provided "as is" and "as available", and you will not hold us responsible or liable for your use of the NHG HealthBot. In particular, the NHG HealthBot relies on experimental technology and may provide inaccurate or offensive content that does not represent our views in any way. You agree to exercise your own discretion in using the NHG HealthBot.

 

5.2  You will also not rely on the NHG HealthBot and/or treat the contents as medical, legal, financial, or other professional advice. Any content regarding those topics is provided for informational purposes only, and will not be treated as a substitute for advice from a qualified professional.

 

5.3  We do not represent, warrant or guarantee in any way that:

i.    you will achieve the same or similar results as other users of the NHG HealthBot;

ii.    your use of the NHG HealthBot will meet your requirements;

iii.    your use of the NHG HealthBot will be uninterrupted, timely, secure or free from error;

iv.    any information obtained by you as a result of your use of the NHG HealthBot will be accurate or reliable; and

v.    that defects in the operation or functionality of any software provided to you as part of the NHG HealthBot will be corrected.

 

5.4  We do not warrant and endorse, and are not responsible or liable for the availability or content of any other Internet site or system (which is not provided, owned or operated by us) linked to or from the NHG HealthBot. Any link provided via the NHG HealthBot is solely for your convenience. These links do not constitute endorsements or recommendations. Access to any other Internet sites or systems is at your own risk and subject to the terms and conditions and/or privacy policies of such Internet sites or systems.

 

5.5  For the avoidance of doubt, you will not hold us liable for any damage or loss of any kind caused as a result (direct or indirect) of the use of any third party website, including, but not limited to, any damage or loss suffered as a result of reliance on the contents contained in or available from any such third party website.

 

5.6  We, our officers, directors, employees and agents will not be liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, loss of revenue, loss of profits, or otherwise, even if foreseeable, arising from or in connection with:

i.    any inaccuracy or incompleteness in, or errors or omissions in the information on the NHG HealthBot;

ii.    you using, visiting or relying on any statements, opinion, representation or information contained in, communicated via, or available from the NHG HealthBot;

iii.    any delay in the operation or transmission, communications failure, internet access difficulties or malfunctions in equipment or software; or

iv.    the conduct or the views of any person who accesses or uses the NHG HealthBot.

 

5.7  Any material downloaded or otherwise obtained through the use of the NHG HealthBot is done at your own discretion and risk and you will be solely responsible for any damage to your device or loss of data that results from the download.

 

5.8  You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to us on or through the NHG HealthBot. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

 

5.9  You may not use the NHG HealthBot or any content on the NHG HealthBot for any purpose that is unlawful or prohibited by these Terms, or to solicit the performance of any illegal activity or other activity which infringes the rights of us or others.

 

5.10  You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the NHG HealthBot.

 

5.11  You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the NHG HealthBot or with any other person's use of the NHG HealthBot. 

 

6. Governing Law and Jurisdiction

 

6.1  The use of the NHG HealthBot, and the Terms, shall be governed by and interpreted in accordance with the laws of Singapore. Any dispute arising out of or in connection with the Terms including any question regarding its existence, validity or termination, shall be referred to and finally resolved by the courts of Singapore.
